Terms and Conditions
Contractor will bill Customer and Customer shall pay Contractor upon Terms Seen On Invoice.
Authorized change orders to be added to Final Payment amount and paid with the Final Payment.
Contractor reserves the right to suspend services if any billing remains unpaid after 15 days. If Contractor determines it to be necessary to employ an Attorney to collect delinquent billings then Customer shall reimburse Contractor for the reasonable costs of such collection action. This agreement shall be terminable upon thirty (30) days written notice by Hedge Landscape, unless terminated earlier for just cause. Customer agrees to promptly notify Contractor, in writing, of any dissatisfaction with the landscape service provided under this agreement in order to assure the services are performed in a manner agreed.
HEDGE LANDSCAPE, LLC – LIMITED WARRANTY:
All nursery stock is warranted to be true to name and quality. Hedge Landscape, LLC shall replace any woody plant material (one time) which fails to survive the first year after the planting date, providing all plants have received reasonable care (watering, spraying, cultivation, and pruning). No warranty is provided for perennials, annuals, bulbs or roses, planters, or for any onsite transplants, plantings under overhangs or areas shielded from natural rainfall. New Lawn Construction: Reseeding of bare areas will be done once on seeded lawn construction. Sod shall be freshly harvested. Washouts due to heavy rainfall are not the responsibility of Hedge Landscape, LLC. Contractor shall perform these services in a workmanlike manner but Contractor does not warrant any damage resulting from the actions or inaction of the Customer or resulting from acts of God. Contractor is not responsible for damage to underground (invisible) dog fences, irrigation systems, landscape lighting, or utilities that are not clearly marked. There are no warranties, express or implied, ordinary, incidental or consequential, or of merchantability other than those expressly set forth above.
SPECIAL NOTE:
Any warranty is conditioned upon payment of the contract price. All materials shall remain property of Hedge Landscape until full payment of contract price has been received by Hedge Landscape.
ADDITIONAL TERMS:
Concealed contingencies such as large rock, construction materials, pipe or other materials, poor drainage not readily apparent or disclosed to Hedge Landscape, LLC may result in additional charges to Customer but shall be disclosed to Customer prior to Contractor undertaking remedial action. Contractor shall not be responsible for any losses, damages or delays resulting from unavailability of materials or plantings, weather, strikes, or acts of nature. Contractor carries public liability insurance with respect to its operations. Contractor participates in the Ohio Workers’ Compensation program and, upon request, will provide Customer with a copy of the Contractor’s current Certificate of Premium Payment.
BURIED UTILITIES:
Sprinkler systems, invisible dog fences and cable lines can easily be damaged during the construction process. Hedge Landscape, LLC will do it’s best not to damage these hidden utilities but is not responsible for additional costs to repair.
ACCEPTANCE OF PROPOSAL:
The above prices, specifications and conditions are satisfactory and are hereby accepted and Customer authorizes the work as specified. Payments will be made as outlined above. Accepted proposals with a total of $1000.00 or more must be Signed and Dated below, and returned to Hedge Landscape, LLC.

Buyer’s Right to Cancel: This is a home solicitation sale, and if you do not want the goods and services, you may cancel this agreement by mailing a notice to the seller. This notice must indicate that you do not want the goods or services and must be postmarked before midnight of the third business day after you sign this agreement. If you cancel this agreement, the seller may keep all or part of any cash down payment.
